You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a binding contract. By purchasing, you represent that all information you provide is accurate and that you have full authority and rights to submit the image, slogan, and destination URL associated with your Plot.

A Plot is a time-limited, non-exclusive license to display a small pixel image and an associated link on the Grid for the period stated at checkout (typically one (1) year from activation, the "Term"). A Plot is not real property, equity, a security, a token, intellectual property in the Grid itself, or any other transferable asset beyond the limited display license described in these Terms.

All purchases are final and non-refundable.

You acknowledge that you are buying a discretionary novelty display placement. Before purchasing, you are solely responsible for carefully assessing your selection, including the Plot location, zone, price, image, slogan, destination URL, and the duration of the Term. We do not offer refunds, partial refunds, credits, exchanges, transfers, relocations, or pro-rated returns for any reason, including but not limited to:

• change of mind, mistake, typo, wrong Plot, wrong image, or wrong link;
• buyer's remorse or dissatisfaction with the Grid, traffic, or visibility;
• removal of your Plot for violation of these Terms (see Section 5);
• downtime, latency, browser incompatibility, or temporary display issues;
• expiration at the end of the Term without renewal;
• changes to surrounding Plots, zones, pricing, or the visual design of the Grid.

Where required by applicable law, the limited statutory rights you may have are not waived by this clause, but you expressly waive any "cooling-off" or withdrawal period to the maximum extent permitted, given that the Plot is a digital placement made available immediately upon approval.

You agree that the image, slogan, destination URL, and any linked content (collectively, "Your Content") will not include, promote, link to, or facilitate any of the following. This list is illustrative, not exhaustive — we reserve sole discretion to determine what is prohibited.

4.1 Political Content

• Political campaigns, candidates, parties, political action committees (PACs), or elected officials in their political capacity;
• Campaign fundraising, voter registration drives tied to a candidate or party, ballot-measure advocacy, or partisan get-out-the-vote efforts;
• Election-related disinformation or material designed to suppress, mislead, or intimidate voters;
• Imagery, slogans, or branding associated with active political campaigns or candidates;
• Links to campaign websites, donation pages, or partisan political organizations.

Civic, historical, and educational content about the institutions of American democracy is permitted, provided it is non-partisan and does not advocate for any candidate, party, ballot measure, or election outcome.

4.2 Hate, Harassment & Derogatory Content

The following are strictly prohibited and will not be tolerated:

• Racism, racial slurs, or racially derogatory imagery, symbols, or language;
• Misogyny, sexism, or content that demeans, objectifies, or threatens any gender;
• Homophobia, transphobia, or content targeting sexual orientation or gender identity;
• Antisemitism, Islamophobia, or content attacking any religion or religious group;
• Xenophobia, nationalism-based hate, or content attacking national origin, ethnicity, or immigration status;
• Ableism or content demeaning people with disabilities;
• Slurs, epithets, dog whistles, hate symbols, or coded hate iconography of any kind;
• Harassment, doxxing, threats, incitement to violence, or targeting of any individual or group;
• Glorification or promotion of hate groups, terrorist organizations, or extremist movements.

4.3 Other Prohibited Content

• Sexually explicit material, nudity, pornography, or content sexualizing minors in any form;
• Graphic violence, gore, animal cruelty, or content glorifying self-harm or suicide;
• Illegal goods or services, controlled substances, weapons sales, or firearms accessories where restricted;
• Fraud, phishing, malware, scams, deceptive offers, "get rich quick" schemes, or misleading claims;
• Cryptocurrency pump-and-dump schemes, unregistered securities, MLMs, or pyramid schemes;
• Gambling or wagering services where prohibited;
• Content that infringes copyright, trademark, publicity, privacy, or other third-party rights;
• Impersonation of any person, brand, government, or organization;
• Personally identifiable information about a third party without their consent;
• Destination URLs that auto-download files, trigger pop-ups, mine cryptocurrency in-browser, redirect through deceptive chains, or otherwise harm visitors;
• Anything unlawful under U.S. federal law or the laws of your jurisdiction.

We review every Plot before activation and may re-review at any time during the Term. We may, at our sole and absolute discretion and without notice:

• reject, edit, blur, or refuse to display Your Content;
• remove, suspend, or permanently disable any Plot;
• terminate your purchase and your account;
• cooperate with law enforcement and disclose information as required by law.

If your Plot is removed or your account is terminated for a violation of these Terms, you forfeit all fees paid and are not entitled to any refund, credit, or replacement placement. You remain liable for any damages caused by the violation.

By submitting Your Content, you grant us a worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to host, store, reproduce, display, distribute, resize, compress, and publicly perform Your Content on the Grid and in promotional materials about the Site for the duration of the Term and for a reasonable archival period thereafter. You retain ownership of Your Content. You represent and warrant that you own or have all rights necessary to grant this license.

Each Plot may link to an external destination URL chosen and controlled solely by the Buyer. We do not own, operate, monitor, endorse, or control any third-party website, page, application, or content reachable through a Plot's destination URL, and we are not responsible or liable for that external content in any way.

Without limiting the foregoing, we are not responsible for:

• the accuracy, legality, safety, decency, or quality of any linked website or its content;
• changes made to a linked destination after a Plot is approved, including a previously compliant URL later hosting prohibited, harmful, offensive, fraudulent, or illegal content;
• domain expirations, hijacking, redirects, parking pages, or a URL being repurposed by a new owner;
• malware, viruses, phishing, scams, drive-by downloads, deceptive practices, data collection, or privacy harms originating from a linked site;
• products, services, transactions, communications, or disputes between you and any third-party site reached via a Plot;
• downtime, broken links, certificate errors, or geographic restrictions affecting a destination URL.

Buyers are solely responsible for the destination URL associated with their Plot and for keeping that destination compliant with these Terms for the entire duration of the Term. We may, at our sole discretion and without notice or refund, disable a Plot's link or remove the Plot if its destination is reported, becomes non-compliant, or otherwise violates these Terms. Visitors who click a Plot do so at their own risk.

Plots are sold on a fixed Term. At the end of the Term, your Plot will be marked expired and may be returned to inventory, re-sold to another Buyer, or visually de-emphasized on the Grid. We have no obligation to notify you before expiration, to renew your Plot, or to preserve Your Content after expiration. If you wish to retain a Plot, you must purchase a new Term before expiration, subject to availability.

Prices are listed in U.S. dollars and are exclusive of any applicable taxes, duties, or fees, which are your responsibility. Payment is processed by a third-party payment processor; by purchasing you also agree to their terms. We may change prices for new purchases at any time without notice. Chargebacks initiated without first contacting us in good faith may result in immediate removal of your Plot and a permanent ban.

You agree to indemnify, defend, and hold harmless 1 Million America and its operators, officers, contractors, and affiliates from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to Your Content, your destination URL and any site it links to, your use of the Grid, your violation of these Terms, or your violation of any law or third-party right.

The Grid and all Plots are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uptime, traffic, or visibility. We do not guarantee any level of impressions, clicks, conversions, search ranking, or commercial result from your Plot, and we make no warranty regarding any third-party site linked from a Plot.

To the maximum extent permitted by law, in no event will our aggregate liability to you for any and all claims arising from or related to these Terms, your Plot, or any third-party site linked from the Grid exceed the amount you actually paid for the Plot giving rise to the claim. We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, or business interruption, even if advised of the possibility of such damages.

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Site or any active Plot after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Grid will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue there. You and we each waive any right to a jury trial and to participate in a class action to the maximum extent permitted by law.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full effect. These Terms, together with the policies referenced on the Site, constitute the entire agreement between you and us regarding the Grid and supersede any prior agreements.
